I am not a lawyer nor do I advise people what to do or what the law is. However, my First Amendment rights are still intact enough that I can relate to others my own opinions and actual anecdotal experiences. I have found that much of my business and activity (purchases etc.) and even routine utilities are now business conducted over the phone. My opinion of what I read in the phone laws tells me that I am entitled to record whenever any recorded message tells me that  the call may be recorded (by them) and I have no obligation to notify ‘them’ that I am recording – in fact any time I have a reason to believe that the call may be recorded by them for any reason I have no obligation to notify them of my recording even under the ‘two party’ notification laws. routinely record all my business conducted over the phone lines. Many times this has saved me having to go to a lawyer to straighten out a mess or prompt others to clean up their mess.

Ninety five percent of every lawsuit is evidence and there is no evidence like documentation. Instead of it being their word against yours, it is their words against their words. Even a recorded episode of an abusive ‘customer rep’ is good in court to show the attitudes and policies used against customers. Many exceptions exist to the ‘two party’ rule even – some instances ‘commercial transactions’ or other records information discussions are NOT considered confidential communications and are recordable. Of course if you insist on recording local government officials who are lying – or peace officers who you know are lying – be prepared for a trumped up search warrant. Also be aware that ‘mandated reporters’ can file false reports of crime and be protected (California penal code 148.5 (e)) from prosecution if they are lying on behalf of police or public agencies. http://www.jebodden.com/

Protect yourself. Stop doing business verbally with liars – document the verbal, thereby making it a ‘writing’ under law. If a business is afraid to do business out in the open daylight – stay the hell away from them.
